If Desire Luzinda or those who were offended by leaked nude photos, said to be hers, lodge a complaint, police will assist to investigate circumstances under which the photos were published on social media, according to Kampala Metropolitan Police spokesman Patrick Onyango.
“We shall investigate the case because it is criminal to publish nude pictures,” Onyango said Monday.
Last week photos said to be of Desire Lunzida were published on social media, sparking a frenzy of questions over the legality or illegality of such publication.
Reports say the photos were leaked following a disagreement between Luzinda and her jilted lover.
Luzinda, according to reports, accused her lover of being a conmen, after she was arrested last Thursday over a Shs21m debt.
however, in reaction, the lover whose details are yet to be established released a series of nude photos resembling those on Luzinda.
However, no independen verification has established whether the photos belong to Luzinda or they were indeed leaked by a jilted lover.
Mr Onyango, said people who publish nude photos can be charged with trafficking in pornography or offensive communication under the Computer Misuse Act.
Efforts to reach Ms Luzinda on whether she is willing to open a criminal case against the person who leaked her photographs were futile as her known mobile phones were switched off.
What the law says.
Section 8 of the Computer Misuse Act says: “Any person who wilfully and repeatedly uses electronic communication to disturb or attempts to disturb the peace, quiet or right of privacy of any person with no purpose of legitimate communication whether or not a conversation ensues commits a misdemeanor and is liable on conviction to a fine not exceeding 24 currency points or imprisonment not exceeding one year or both”.
Section 13 of the Anti-pornography Act, makes it illegal for a person to produce, traffic, publish any form of pornography and on conviction is liable to fine of Shs10m or imprisonment not exceeding 10 years.
